Bizimply (“we” or “us“) is committed to protecting and respecting your privacy.

This policy (together with our Terms of Use and any other documents referred to in it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. For the purposes of Data Protection Legislation (currently in Ireland the Data Protection Acts 1998 and 2003 and, with effect from 25 May 2018, the GDPR) the data controller is Bizimply Limited. 1. PERSONAL INFORMATION WE COLLECT FROM YOU

We collect and process the following personal information about you:

1.1 Information you give to us when you visit our site and request a product demonstration, download onsite resources, register for our services or by corresponding with us by phone, e-mail or otherwise, we ask for certain personal information. This includes some or all of your name, address, e-mail address, phone number and job title. For Customers that purchase a paid version of the Services, our corporate affiliates and our third party payment processors may collect and store billing address and credit card information on our behalf or we may do this ourselves.

1.2 Information we collect about you with regard to each of your visits to our site we will automatically collect the following information:

1.2.1 Technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;

1.2.2 Information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time); items you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our customer service number.

1.3 Information we receive from other sources we are also working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you from them, resulting from the work they carry out on our behalf.

2. USES MADE OF THE PERSONAL INFORMATION

2.1 We use information we collect about you in the following ways:

2.1.1 Information you give to us

We will use this information:

(a) to carry out our contractual obligations arising from any contracts entered into between you and us for any of our services;

(b) to provide you with a demo or other information that you request from us;

(c) subject to your consent, to provide you with information about other services we offer that are similar to those that you have already purchased or enquired about;

(d) to notify you about changes to our service.

2.1.2 Information we collect about you

We will use this information:

(a) to administer our site and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;

(b) to improve our site to ensure that content is presented in the most effective manner for you and for your computer;

(c) to allow you to participate in interactive features of our service, when you choose to do so;

(d) as part of our efforts to keep our site safe and secure.

2.1.3 Information we receive from other sources

We may combine this information with information you give to us and information we collect about you. We may us this information and the combined information for the purposes set out above (depending on the types of information we receive).

3. DISCLOSURE OF YOUR PERSONAL INFORMATION

3.1 We may share your information with any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in the Companies Act 2014 for the purposes of providing our services to you.

3.2 We may share your information with our service providers being:

(a) Credit reference agencies for the purpose of assessing your credit score where this is a condition of us entering into a contract with you;

(b) We may engage third party companies or individuals, such as third party payment processors, to process information on our behalf.

(c) Analytics and search engine providers that assist us in the improvement and optimisation of our site.

3.2 We may disclose your personal information to third parties:

(a) If Bizimply Limited or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.

(b) If we are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation, or in order to enforce or apply our Terms of Use or other agreements with you;

(c) To protect the rights, property, or safety of Bizimply Limited, our customers, or others; this includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

4. WHERE WE STORE YOUR PERSONAL INFORMATION

4.1 Bizimply takes security seriously. We take various steps to protect information you provide to us from loss, misuse, and unauthorised access or disclosure. These steps take into account the sensitivity of the information we collect, process and store, and the current state of technology.

4.2 All customer account data is stored on secure servers. Bizimply’s primary data centre is hosted with Amazon Web Services (AWS).

AWS is a leading provider of cloud computing services and operates one of the largest and most secure network of data centres in the world. Bizimply is hosted in the EU West region of AWS. Database backups are run on a regular basis and stored on the AWS S3 service in the EU West region.

4.2 We will not transfer your customer account information outside the EEA.

5. DATA RETENTION

5.1 Bizimply will retain Customer Data in accordance with a Customer’s instructions, including any applicable terms in the Customer Agreement and Customer’s use of Services functionality, and as required by applicable law. The deletion of Customer Data and other use of the Services by Customer may result in the deletion and/or de-identification of certain associated information. Bizimply may retain Other Information pertaining to you for as long as necessary for the purposes described in this Privacy Policy. This may include keeping certain information after you have deactivated your account for the period of time needed for Bizimply to pursue legitimate business interests, conduct audits, comply with (and demonstrate compliance with) legal obligations, resolve disputes and enforce our agreements.

6. YOUR RIGHTS

6.1 Individuals located in certain countries, including the European Economic Area, have certain statutory rights in relation to their personal data. Subject to any exemptions provided by law, you may have the right to request access to Information, as well as to seek to update, delete or correct this Information. You can usually do this using the settings and tools provided in your Bizimply account. If you cannot use the settings and tools, contact [email protected].

6.2 We may send you service, technical and other administrative emails, messages and other types of communications. We may also contact you to inform you about changes in our services, our services offerings, and important service-related notices, such as security and fraud notices. These communications are considered part of the services associated with your Bizimply account and you may not opt out of them. In addition, we sometimes send emails about new product features, promotional communications or other news about Bizimply. These are marketing messages so you can control whether you receive them via unsubscribe options on all communications.

6.3 Our site may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

Bizimply uses cookies and similar technologies in our Websites and Services. The Websites and Services may also include cookies and similar tracking technologies of third parties, which may collect information about you via the Websites and Services and across other websites and online services.
